Ugh, I hate it when that happens. I agree and would try to contact the host. Although, I've never had luck with contacting thieves or their Web hosts. It angers me that people are so lazy and unethical.
I was reading someone's blog once (can't remember who) and they wrote an entire post about the thief. It was very clever how they documented what they stole, etc. I guess the only problem with writing them up on your site is that you are linking to the page with the duplicate content and that can hurt you.
Anyway, hopefully you get that matter resolved.
