Just like anything else there's always that risk but I personally have not heard this happening to anyone regarding SBI!. I'm no lawyer so I don't know how well this would hold up, but you could draft up a letter prior to sending the money stating that the person agrees to send over the SBI! membership upon receiving payment and have them sign it or email it back to you stating they agree with the terms. Again, not sure how binding that would be (anyone?) but that's a start.
